my case worth less because I was hurt there before?
A:
The answer depends widely on the injury. As you can see from Table
A, the settlement value of shoulder injuries are
significantly affected by underlying degenerative changes, as are
serious spinal injuries (fractured vertebrae and disc herniations).
The effect on knee injuries is relatively modest, as is the
case with less severe common flexion/extension spinal injuries. Data
based on a study of 400 insurance settlements between 1986 and 2002,
adjusted for the cost of living.
